On Saturday, Shiv Sena (UBT) leader Priyanka Chaturvedi slammed the BJP-led Centre in response to a Delhi court ruling ordering suspended AAP Rajya Sabha MP Raghav Chadha to vacate his mansion. She accused the ruling party of having a "vindictive attitude" toward legislators and questioned the allocation of government properties, claiming that an examination of records would demonstrate that bungalows are routinely granted "beyond their designated term."
"If government records are properly examined, it will be discovered that these government bungalows are frequently assigned outside of term." Many people are able to move into such residences despite not being eligible. "The targeting of one person demonstrates the ruling party's vindictive attitude," Chaturvedi was reported as saying by the news agency ANI.
In a setback for Chadha, a Delhi court declared on Friday that he had no right to remain in the government property allotted to him after the allotment was cancelled. The interim stay granted to the AAP MP has been lifted by the court.
The decision of the Delhi High Court
A Delhi court ruled that AAP Rajya Sabha MP Raghav Chadha had 'no vested right' to keep the government bungalow, a type-7 home on Delhi's Pandara Road, occupied. Raghav Chadha no longer has a genuine claim to the home, according to the court, because the allotment was cancelled and ministerial rights were revoked. Initially, an interim judgment granted Raghav Chadha permission to live in the home on April 18, but this decision has now been withdrawn by additional district judge Sudhanshu Kaushik of Patiala House Courts, according to LiveLaw. The Rajya Sabha secretariat has also filed a review plea, asking for the interim order to be reconsidered.
"Raghav Chadha cannot claim that he had an absolute right to remain in the accommodation throughout his entire tenure as a Rajya Sabha Member." The court stated that "the allotment of Government accommodation is only a privilege granted to the plaintiff, and he has no vested right to continue to occupy the same even after the cancellation of allotment."
What exactly is the problem with Raghav Chadha's bungalow?
Raghav Chadha was given a class 7 room at the Pandara Road bungalow in 2022. However, this allotment was canceled in March 2023 on the grounds that a type 7 accommodation exceeded his entitlement. He was instead given a type 6 flat. Raghav Chadha challenged the cancellation in court, and a stay was given, preventing his eviction from the home without sufficient legal process. Raghav Chadha and his parents then performed repairs and moved into the bungalow.
